1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Togiya Miami LLC ("TOGIYA Miami," "we," "us," or "our"), a limited liability company registered in the State of Florida. By booking our services or using our website at togiyamiami.com, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services or website.
2. Services Description
TOGIYA Miami provides professional knife sharpening services using traditional Japanese togishi techniques, serving residential and commercial clients in the Miami, Florida metropolitan area through a pickup and delivery model. Our services include, but are not limited to:
- Japanese single-bevel knife sharpening (Yanagiba, Deba, Usuba, etc.)
- Western double-bevel knife sharpening (Chef's knife, Santoku, Paring, etc.)
- Tip repair and blade restoration
- Traditional geometry maintenance
- Hand-polished mirror finish
Services are provided exclusively on a pickup-and-delivery basis. We collect your knives from your location, sharpen them at our facility, and return them within the agreed timeframe. We do not perform on-site sharpening at the client's location.
3. Service Area and Pickup Schedule
TOGIYA Miami currently serves the following neighborhoods with free pickup and delivery: Brickell, Downtown Miami, Coral Gables, Coconut Grove, and Wynwood.
Service to areas outside this zone is available subject to an additional travel fee, which will be communicated to you prior to confirming the booking.
Pickup and delivery are available on Mondays, Wednesdays, and Fridays only. Scheduling is subject to availability and confirmation by TOGIYA Miami.
4. Booking and Confirmation
Bookings are submitted through our online booking form at togiyamiami.com/booking. A booking request does not constitute a confirmed appointment until you receive a written confirmation from TOGIYA Miami via email.
We reserve the right to decline or reschedule any booking at our discretion, including due to capacity constraints or service area limitations. In such cases, we will notify you promptly and offer alternative dates.
5. Payment Terms
Payment is due upon completion and delivery of the sharpening service. We accept the following payment methods:
- Zelle — no transaction fee.
- PayPal — standard PayPal fees may apply.
- Credit / Debit Card — processed via Square; a processing fee may apply.
- Cash — accepted at the time of delivery.
Pricing is based on knife type, condition, and service selected. A final price will be confirmed before work begins. We reserve the right to adjust pricing if the knife requires additional work beyond what was initially assessed.
6. Liability for Knife Damage
TOGIYA Miami takes full responsibility for any damage caused to your knives as a direct result of our sharpening services. In the event of damage attributable to our work:
- We will make every reasonable effort to repair the knife at no additional cost to you.
- If repair is not feasible, we will provide a replacement knife of equivalent or greater value, or offer monetary compensation at fair market value.
To protect both parties, we recommend that you disclose any pre-existing damage, cracks, chips, or structural weaknesses in your knives at the time of booking or pickup. TOGIYA Miami is not liable for damage resulting from pre-existing conditions that were not disclosed.
Our liability is limited to the replacement value of the knife(s) in question. We are not liable for consequential, incidental, or indirect damages arising from the loss of use of your knives.
7. Client Responsibilities
By booking our services, you agree to:
- Ensure that someone is available at the agreed pickup location and time.
- Disclose any pre-existing damage or special handling requirements for your knives.
- Handle all knives safely before and after service — sharpened knives are extremely sharp.
- Keep sharpened knives out of reach of children.
- Not use knives on surfaces or materials that could damage the edge (e.g., glass cutting boards, ceramic plates).
8. Cancellation and Rescheduling
We understand that schedules change. If you need to cancel or reschedule your appointment, please notify us at least 24 hours in advance by emailing [email protected].
Cancellations made less than 24 hours before the scheduled pickup may be subject to a cancellation fee to cover logistics costs. No-shows without prior notice may result in a fee for the missed appointment.
TOGIYA Miami reserves the right to cancel or reschedule appointments due to unforeseen circumstances (weather, emergencies, etc.). In such cases, no cancellation fee will be charged to the client.
9. Knife Safety Disclaimer
Professional knife sharpening results in extremely sharp edges. TOGIYA Miami is not responsible for any injuries or accidents that occur after the knives are returned to the client. By accepting your sharpened knives, you acknowledge:
- The knives are significantly sharper than before service.
- Proper knife handling and storage practices are your responsibility.
- You will use appropriate protective equipment (cut-resistant gloves, knife guards) as needed.
10. Intellectual Property
All content on the TOGIYA Miami website — including text, images, logos, graphics, and educational materials — is the property of Togiya Miami LLC and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
12. Dispute Resolution
In the event of a dispute, we encourage you to first contact us directly at [email protected] so that we may attempt to resolve the matter informally. We are committed to fair and prompt resolution of any issues.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last updated" date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
